Special Needs Trusts: What You Should Know

It’s important to understand that you can’t dissolve a Special Needs Trust, and they can be difficult to change or amend. This is not necessarily a bad thing, as it can offer asset protection, but it’s something to be aware of.

A First Party (or Self-Settled) Trust is generally funded by assets received from either an inheritance or a lawsuit. A Third Party SNT can be funded by a parents’ or grandparents’ Trust. And finally, a Pooled SNT puts together multiple beneficiaries’ Trust assets to create a larger asset base that’s managed by an organization and a professional Trustee.

Because there are three types of Special Needs Trusts and they are taxed in different ways, understanding each type can help you set up the most beneficial type of Special Needs Trust possible.

Most Special Needs Trust are designated a complex Trust for tax purposes. If this is the case, the Trust would report deductions, income and credits.

Properly sign your documents in the presence of your witnesses and notary. After your witnesses also sign, the notary will provide their signature and seal. Then, safely store your documents for safekeeping. No need to mail your documents back to us.
