PLEASE NOTE: THESE SMS TERMS AND CONDITIONS CONTAIN A MANDATORY ARBITRATION AND CLASS ACTION WAIVER AS DETAILED IN SECTION 22 OF THE TRUST AND WILL TERMS OF SERVICE, WHICH ARE INCORPORATED AS IF FULLY SET FORTH HEREIN. PLEASE READ CAREFULLY. YOU MUST SUBMIT YOUR DISPUTES TO BINDING AND FINAL ARBITRATION ON AN INDIVIDUAL BASIS UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 22 OF THE TRUST AND WILL TERMS OF SERVICE.

These SMS Terms of Service (the “SMS Terms”) govern the provision, receipt, and delivery of text messages by or on behalf of Trust & Will (“Trust & Will,” “we,” “us,” or “our” refer to Huge Legal Technology Company, Inc., the owner and operator of www.trustandwill.com). Depending on the consent you’ve provided, our text messages (the “Trust & Will Texts”): (1) provide you with information you requested from us; (2) respond to your questions and other inquiries; (3) provide updates regarding transactions with or through us; and/or (4) provide you with marketing or promotional content that may interest you, including reminders about pending items in your online shopping cart.

E-SIGN Disclosure and Agreement

By providing your consent to receive Trust & Will Texts (as described above), you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying with STOP to any text message you receive.

Agreement and Consent to Receive Trust & Will Texts

You can provide us with your consent to receive Trust & Will Texts in multiple ways, such as by providing us with your phone number during or after registration, through communications or transactions with us, or by opting into receiving marketing Trust & Will Texts. By providing your consent, you agree to these SMS Terms, the Trust & Will Privacy Policy , and the Trust & Will Terms of Service.

By providing consent, you authorize us or our service providers to use automated or nonautomated technology to send Trust & Will Texts to the number associated with your consent. You may opt into receiving Trust & Will Texts with marketing content, and consent to receiving marketing texts is not a condition of purchase.

After opting into Trust & Will Texts, in addition to the main messages the service offers, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your consent to receive Trust & Will Texts.

Eligibility

By consenting to receive Trust & Will Texts, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms and the Trust & Will Terms and Conditions. You further represent that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and for which you are authorized to opt into Trust & Will Texts.

Costs of Trust & Will Texts

Trust & Will does not charge you for Trust & Will Texts. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

About Trust & Will Texts and Opting Out

Message and data rates may apply. Unless otherwise noted, we may send multiple, recurring messages. You can get help by texting HELP to +1 (833) 233-8520, and you can opt out by texting STOP to +1 (833) 233-8520. For Trust & Will Texts operated through a different number, text HELP to that number for help and STOP to that number to opt out. Your opt-out request may generate either a confirmation text or a texted request to clarify the Trust & Will Texts program to which it applies (if you have more than one). To complete your opt-out, please provide the requested clarification. 

Trust & Will Texts sent from short codes are supported on all U.S. carriers. Please note, however, that the supporting mobile carriers may change without notice, and the particular Trust & Will Texts program you join, including those operated through a different number, may be limited to specific carriers. Trust & Will and the mobile carriers are not liable for delayed or undelivered messages.

Discontinuing or Transferring Your Phone Number

If at any time you intend to stop using the mobile telephone number that has been used to subscribe to Trust & Will Texts, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the opt out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these SMS Terms. If you fail to notify us before discontinuing or transferring your mobile telephone number, you acknowledge that Trust & Will is not responsible for any messages sent to your form number after the transfer, and that any such messages may be received by the new holder of that number.

Modifications to these SMS Terms

We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in Trust & Will Texts shall be deemed to constitute acceptance by you of such modifications, additions, or deletions.

We may change any short code or telephone number we use to operate the Trust & Will Texts at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
