Mystery Will, Major Consequences: The Tony Hsieh Estate Planning Dilemma

Nearly five years after the death of Zappos CEO Tony Hsieh, a mystery will has suddenly appeared. Keep reading to learn more.

Nearly five years after the tragic death of former Zappos CEO Tony Hsieh, a mysterious will has suddenly appeared, throwing his $500 million estate into turmoil and creating significant complications for his family.

This unexpected document, allegedly signed by Hsieh in 2015, was mysteriously delivered in an unmarked envelope to a Nevada attorney named Robert Armstrong (who had no prior connection to the entrepreneur.)  What makes this situation particularly unusual is that Armstrong is named as a co-executor of Hsieh's estate in the will, yet he claims he never met Hsieh and had no role in his estate planning.

A Perplexing Probate Case Unfolds

Until this will surfaced, Hsieh's family had been operating under the assumption that he died intestate—without a will. His father, Richard Hsieh, has been serving as the administrator of the estate for more than three years.

The newly discovered document includes provisions for over $50 million in assets and several Las Vegas properties, directing them into a series of trusts with unnamed beneficiaries.  It also outlines charitable donations—including a $3 million gift to Hsieh's alma mater, Harvard University—as well as additional gifts to foundations and family members.

Adding another layer of complexity, shortly after receiving the will, Armstrong received a phone call from a man identifying himself as Kashif Singh. Singh explained that the will had come from his late grandfather, Pir Muhammad, who was named in the document as a co-executor and allegedly suffered from dementia before passing away.

At a recent court hearing in Las Vegas, there was little clarity on whether the document is legitimate—or where it even came from.

Critical Estate Planning Lessons

The Hsieh estate situation highlights several crucial lessons about proper estate planning:

1. Document Authentication and Proper Execution Matter

The questions surrounding the legitimacy of Hsieh's will underscore the importance of proper document execution and authentication. A properly executed will should leave little room for doubt about its validity.

2. Secure Storage is Essential

The mysterious appearance of this will five years after Hsieh's death demonstrates why secure, known storage of estate documents is critical. Your loved ones should know exactly where to find your estate planning documents when needed. 3. Communication is Key

Even if Hsieh did create this will in 2015, the fact that his family was unaware of its existence shows the importance of communicating your estate plans to key family members and advisors. Many people are uncomfortable with communicating their estate plans, so a good starting place is to think about what you’re trying to accomplish when you’re going to talk to your family about your plan: Do you want to share details about the plan or keep your conversation more general, addressing that your estate plan is done and who to contact when and if the day comes to get copies of documents.

4. Professional Oversight Prevents Problems
